As I understand the IBC rules this is not a legal signing for two reasons:

1. Benitez does not have a signed contract with a major league organization, and

2. If he signs one now he will be eligible for the next IBC draft.

Had Benitez been drafted in the last draft he would be legal, I believe ...

Edysbel Hernandez - SP - Player

The Blue Jays are one of five teams showing interest in Cuban pitcher Edysbel Benitez, according to agent Joe Rosario.

Benitez, 22, defected two years ago. He spent the winter pitching in the Nicaraguan Winter Baseball League -- a clear step down in quality from the four main winter leagues -- and had a 3.38 ERA in 72 innings. "He's major league-ready right now," said Rosario, who is seeking a three-year big-league deal for the pitcher. "If a deal gets done, he'd probably only need four or five games in Triple-A and then I think he'd be ready." It's more likely that he'll spend the entire season in the minors after signing. Mar. 22 - 4:00 a.m. ET

Yep, it's not a legal signing. He can't even go in our 07 signings thread yet, for goodness sakes.

I'm pretty sure that Nils has never read any of the emails or threads on league rules. :)

If drafted, he would have had to sign with a team by opening day or be returned to the draft pool for 2007.

1. Following the completion of the IBC draft, any players who were drafted by or signed to a contract by an MLB team during the prior calendar year (in 2006 for the example above) or earlier may be signed as free agents.
2. A player will be returned to the draft pool for the next season under the following conditions. If the player was drafted by an MLB team and does not sign a new contract before the next MLB draft (the 2007 MLB draft in the example above). If the player is a Cuban defector or is from another professional league such as Japan, Korea or Mexico and does not sign a contract with an MLB team by opening day (Opening Day of the 2007 season in the example above).
